Assistance is provided in the form of loan restructuring. In this case, restructuring can be carried out either by concluding an agreement between the creditor and the borrower (joint and several debtors) to change the terms of a previously concluded loan agreement(loan agreement), and by concluding a new loan agreement (loan agreement) for the purpose of full repayment of debt on a restructured mortgage loan. To conclude debt restructuring, the borrower must submit an application to the credit institution.

Maximum support amount

The maximum amount of compensation for the loan is 30% of the balance of the loan (loan) calculated as of the date of conclusion of the restructuring agreement, but not more than 1.5 million rubles.

Duration of the program

Conditions for providing support to mortgage borrowers

Condition 4 – requirements for room area.

Condition 5 – the only housing.

Assistance is provided only if there is only one place to live. In this case, it is allowed to have a total share of the mortgagor and his family members in the ownership of no more than 1 other residential premises in the amount of no more than 50 percent.

Important. Compliance with these conditions is confirmed by the borrower’s application in a simple writing. The borrower is not required to provide information from the Unified State Register of Real Estate. Joint Stock Company "Housing Mortgage Lending Agency" verifies the information provided by the borrower in accordance with this subparagraph.

Condition 6 – term for concluding the loan agreement.

Support is provided only for those loans for which the agreement was concluded at least 12 months before the date the borrower submits an application for restructuring, except in cases where mortgage(loan) was provided for the purpose of full repayment of debt on a residential mortgage loan (loan) provided at least 12 months before the date the borrower submitted an application for restructuring.

New exceptions. Clause 9 of the new Conditions of the program (as amended by Decree of the Government of the Russian Federation dated August 11, 2017 N 961) stipulates that in the event of non-compliance with no more than two conditions provided for in clause 8 of this document, payment of compensation under the program is allowed in accordance with the decision of the interdepartmental commission in the manner provided for by the regulations on the interdepartmental commission.

Please note that the program does not provide for complete exemption of the borrower from making monthly loan payments, from paying fines, penalties and penalties accrued under the terms of the loan agreement (loan agreement). The lender may consider partially or completely writing off fines, penalties and penalties for late payments incurred during the period of deterioration in the borrower’s solvency. Due to a significant deterioration in the financial situation of citizens of the Russian Federation in 2015, the state decided to provide assistance to mortgage borrowers belonging to social groups. This project implemented through the Housing Mortgage Lending Agency (AHML). Options for helping mortgage borrowers

Direct assistance can be provided in one of four ways.

  1. Repaying part of the mortgage principal. This option provides for a one-time transfer of funds, the volume of which cannot exceed 20% of the debt balance at the time of restructuring and 600,000 rubles (30% and 1,500,000 rubles for large families, and those who have two minor children), with the intended purpose of reducing the amount of the principal debt.
  2. Reduced monthly payment. Its size will be reduced by at least 50% for up to 18 months.
  3. Decline interest rate . If the mortgage was originally issued in rubles, then the level of the newly established commission for use borrowed money should not exceed its current value, and for loans in foreign currency - no more than 12% per annum.
  4. Changing the lending currency. Assistance is provided for the restructuring of debt from foreign currency in rubles at the rate established by the Central Bank of the Russian Federation at the time of execution of the transaction.

It is worth noting that deferred payment is also available. That is, it is provided Grace period for mortgage repayment, which provides for the period of its validity the release of the borrower from the obligation to pay part of the principal debt and accrued interest.

Conditions for obtaining assistance to mortgage borrowers from AHML

To use the program, the mortgage borrower, in addition to being a citizen of the Russian Federation, must meet all four basic requirements. If at least one of the conditions is not met, then assistance will, unfortunately, be denied.

1. Attitude towards social group . It will be enough to meet one of the following conditions:

  • Has one or more minor children (own, adopted or officially under their care);
  • Combat veteran;
  • You yourself are disabled or there is a disabled child in the family;
  • A dependent student under the age of 24 is supported.

2. Insufficiency family income . If previously (before 2017) a mandatory reduction in the borrower’s salary by at least 30% was required, this condition has now been canceled. To meet this requirement, it is enough that the average family income for the last three months, after paying off the mortgage loan, does not exceed two subsistence minimums corresponding to the region of residence of the borrower, for each member of his family.


For example, a person living in the Saratov region received 150,000 rubles over the last 3 months. Thus average salary it will be 50,000 rubles. His family consists of three people - himself (borrower), wife (co-borrower) and a minor child. The spouse receives maternity payments, the amount of which for the last 3 months amounted to 30,750 rubles. That is, the average value is 10,250 rubles. Planned expenses, according to the schedule, to pay the mortgage monthly are 15,430 rubles.

The calculation is made as follows. The cost of repaying the mortgage is subtracted from the total family income, which in this case will be 60,250 rubles per month. The net balance will be 44,820 rubles. This amount will need to be divided among all family members, that is, 3. Accordingly, each will receive 14,940 rubles.

Now all that remains is to check the income amounts with double the subsistence minimum, which in the corresponding region is 8,773 rubles for the able-bodied population, and 8,300 rubles for children. Each capable family member (borrower and co-borrower) must have an income of up to 17,546 rubles, and for a child – up to 16,600 rubles. All values ​​exceed the actual average income received for each family member. Thus, according to the example, the borrower meets the second requirement of the program.


3. Compliance with living space. In addition to the mandatory use of an apartment, which is also located on the territory of the Russian Federation, as collateral for a mortgage loan, it is necessary that it:

  • According to the estimated value, based on the price per 1 sq. meter, does not exceed 60% of the cost of 1 sq. meters of corresponding real estate according to Federal service state statistics at the time of execution of the loan agreement;
  • The total living space did not exceed 45 square meters. meters, if its layout indicates 1 room;
  • The total living space did not exceed 65 square meters. meters, if its layout indicates 2 rooms;
  • The total living space did not exceed 85 square meters. meters, if its layout indicates 3 rooms or more.

It is worth considering that all requirements for footage and cost do not apply to citizens who have three or more minor children in their family. 4. The only housing. The property specified in the third paragraph must be the only premises suitable for living owned by the mortgagor. Although it is allowed for the borrower himself and his family members to own up to 50% of one other residential property.

Procedure for obtaining assistance

For the borrower, if you do not take into account the process of collecting the necessary package of documents, the process of using this program is quite simple. You just need to contact your bank with the appropriate set of documents and an application for restructuring. New rules for the state program to help mortgage borrowers who find themselves in difficult financial situations came into force in Russia on August 22. As AHML clarified, 97 banks that collaborated with AHML previously under the previous version of the program are participating in the program.

At the same time, the rate on a restructured foreign currency mortgage should not be higher than 11.5%.

To reduce loan obligations, the borrower may be offered one of the types of restructuring: for loans previously issued in foreign currency, it is possible to change the currency to rubles at a rate lower than that established by the Bank of Russia at the time of concluding the restructuring agreement; one-time forgiveness of part of the loan amount.

When concluding a restructuring agreement, the lender does not have the right to charge fees to the borrower for actions related to the restructuring, or to shorten the loan term.

  • Residential premises owned by the mortgagor are his only housing, including residential premises, the right of claim to which arises from an agreement for participation in shared construction, the mortgage of which is security for the fulfillment of obligations under a credit agreement (loan agreement). In this case, it is allowed to have a total share of the mortgagor and his family members in the ownership of no more than 1 other residential premises in the amount of no more than 50%. Compliance with these requirements is confirmed by a simple written statement from the borrower. Provision by the borrower of incomplete and (or) unreliable information is grounds for refusal to restructure a housing mortgage loan (loan);
  • The credit agreement (loan agreement) was concluded at least 12 months before the date the borrower submitted an application for restructuring, except for cases where the mortgage loan (loan) was provided for the purpose of full repayment of debt on a housing mortgage loan (loan) provided no less than 12 months before the date the borrower submits the restructuring application.

In case of non-compliance with no more than two conditions, payment of compensation under the program is allowed in accordance with the decision of the interdepartmental commission in the manner prescribed by the regulations on the interdepartmental commission.

The maximum amount of compensation for each restructured mortgage housing loan (loan) is 30% of the balance of the loan amount calculated as of the date of conclusion of the restructuring agreement, but not more than 1,500 thousand.
