It happened in the afternoon when the owner of one of these apartments was at home.

- The first glass flew out during the day when I was at home. Dined, watched TV, heard a pop. I look - there is no glass. The shards lay down right on the sidewalk. Another fell at night. I discovered this in the morning when I was walking the dog and came across broken glass in the same place. I think: "Who else is so lucky?" It turned out - again to me. Winter is on the doorstep, and we are saving ourselves with homemade frames with polycarbonate, because it is simply impossible to get help or compensation from someone. We are already tired of writing and asking, we are simply at a dead end. But in the wind, all the stained-glass windows sway. The process has already begun, and sooner or later all the stained-glass windows will fall out. The only question is, who cares? - said the owner of one of the affected apartments.

After the publication of the publication, the administration of the Oktyabrsky district convened an emergency meeting to which it invited representatives of the developer, contractor, the company that installed the windows, and representatives of the residents. There it was decided to go to the object to see the state of the windows and what to do with them.

On Wednesday morning, all responsible persons gathered near the house. While waiting for the contractor's representatives, I decided to go around the house around the perimeter, look at the windows.

- Mikhail Mikhailovich, you say that rubber bands pop out of windows en masse, - the deputy head of the administration addressed to the deputy chairman of ZhSPK Mikhail Schastny. - I looked at this side of the house and maybe not everything is visible from the ground, but I see only one such window.

- We have to look from the apartment, it is hard to see from here, - explains Mikhail Schastny, deputy chairman of this ZhSPK.

- You can see directly those rubber bands that have already taken off. That is, windows will fly after them. Because the glass only holds on to them, explained the deputy chairman of ZhSPK. - In the rest of the apartments, the rubber bands are kept on parole.

- Okay, let's go into the apartments, we'll see.

So who will be in charge of the windows falling out? Why is this happening at all? It's scary!- the tenants asked.

- We looked and analyzed the project together with the designer. It's not that scary, it's not good - yes. But for safety reasons, the project provides for the installation of tempered glasses, so it is not entirely correct to say that they flew out, it is correct to say that they broke. In the event of a break, the tempered glass shatters into small fragments and crumbles downward. That is, it does not threaten people's lives, - believes Deputy Head of Administration Pavel Toma... - Why they crash is a separate question, and it can be solved only in court and when appointing a special technical and construction expertise. Because, just looking at the windows, not a single expert will say why they crashed: whether it was a child hit by a ball, or knocked out by the wind. Some glass, people say, flew out in this house during the hurricane on July 13th. But a hurricane is force majeure, it knocked down forests in half of Belarus, and it is impossible to say that this bears some kind of systemic character. The reason for the breaking of the windows can be established by an examination, which hardly anyone will do at their own expense. They will do it only if ZhSPK files a lawsuit. And the rest of the technical issues - rubber bands and the rest - we'll see and decide what to do with them. The contractor does not shy away from fulfilling the warranty obligations. Unfortunately, citizens' applications on these issues were handed over to the contractor only last week and they have not yet been dealt with.

According to the deputy head of the administration, the customer, the Minsk branch of Belarusian Railways, has withdrawn from solving problems in the house. How Gosstroyekspertiza accepted the house in such a state, the representative of the executive committee could not answer either.

The contractor's representatives were late for the meeting with the tenants and the administration. The residents were freezing and discussing problems.

- We have it blowing from all the cracks of this French balcony, - the woman is indignant. - I've already covered everything with carpets and blankets. But this is not the case! You come up and whistle from everywhere.

- Yes, I have a million problems in the apartment. Housing and communal services and contractors came, and there was zero movement, ”says the owner of another apartment. - My condensation collects between the glasses, and the coils are cold: I washed my woolen socks and I can't dry them for two days. Trouble, not home. They say, they say, why did you sign the acceptance certificate, if everything is so bad. So when I signed it, everything worked: the coils were hot, no condensate collected. Who knew that it would be so.

In addition to the windows, a lot of problems have accumulated in the house: in the morning, in the evenings and on weekends there is no hot water, the walls are leaking, there are not only hoses in the fire shields on the floors, but even protective valves on the pipes. The tenants decided to tell the officials about all this.

- On weekends, in the morning and in the evening, there is no hot water. We have been living here for five months, in the evening, at 8-9 o'clock, it is impossible to wash the child. We turn on the heater to do this, ”says one resident of the deputy head of the administration.

- Is the pump failing? - the deputy head clarified with the representatives of the housing department.

- Yes, something with the temperature. There is pressure, but there is no temperature. We will check, - answered the communal workers.

After almost an hour in the cold, the audience decided to go up to one of the apartments, where the windows did not fly out. But, according to the owner, only for now.

In the apartment, the deputy head of the administration and a representative of the developer went out onto the balcony and began to touch the glass. Almost all the windows were loose, the rubber bands had come off in various places.

- Listen, this is not the case - the window is kept on one elastic band, - Pavel Toma was also indignant.- It must be supported by the glazing bead. At a meeting that was the other day, we were assured that the windows are supported by fasteners, and not by elastic bands. The director of the contractor company spoke about this. But he is the director, he did not install them himself, his employees told him that everything was done correctly. Therefore, now we will understand. Even a non-window specialist understands that it doesn't have to be this way. The glass vibrates, this vibration is transmitted to the rubber band, it falls out, and the window no longer holds on to anything.

- In several places it was already falling out of me, I myself fastened it back, - says the owner of the apartment. - And what will happen next? Will the windows start falling out?

- An elastic band is not a load-bearing element, it should not be held, - confirmed the members of the commission.

- So who will be responsible for this?

- Responsible for what specifically? - surprised Pavel Toma... - The company "Minsk House of Windows", which made the installation drawings and installation, is now in the process of liquidation. They do not have technical specialists now, they do not conduct business activities now. The contractor filed a lawsuit against them, but no one knows whether they will receive the money.

Who will change the windows in the house, if the commission decides that there is such a need, according to a representative of the administration, the court will decide.

- We cannot appoint the guilty and demand replacement from them, - said Pavel Toma... - Yes, and hardly anyone on a voluntary basis now wants to take responsibility.

The deputy head of the administration explained that all the issues that will be raised during the tour of the apartments will be recorded in the protocol. Then they will be considered with the contractor and the operating organization. But the official stressed once again that ZhSPK should go to court as soon as possible in order to find the perpetrators through it, who will correct the problems with the windows. While the issue will be considered at meetings and in court, the district administration for the safety of residents has promised to fence the house around the perimeter so that no one walks under the windows.

The state cannot do anything with unscrupulous employers who do not pay their employees. Court orders are easy to get around or just ignore. And people are waiting for their money to this day: someone for several months, someone for almost a year. Many no longer even hope to receive them.

Windows to nowhere

“For more than 6 months we have not been able to receive our salary,” Vladimir, a former employee of Minsk House of Windows LLC, complained to Nasha Niva.

In August 2014, he got a job as a worker. The problems began a month later, when the time came for the first earnings: instead of the promised 6 million, the man received only 1 million. And not only he - the full amount was not given to anyone.

“I worked at the company for about 6 years,” says Maksim, a former engineer at the House of Windows. - Last spring they stopped giving money for car depreciation, and at the beginning of summer they stopped paying salaries. At all. I even paid for business trips out of my own pocket. "

The management asked to wait a little, they say, they have not yet been paid for work at the airport. A month has passed. Nothing changed.

The management explained the problems with the same clients.

“Then we workers stopped working for the day. General Director Valery Bordun came to us and said: “You can do whatever you want with me, but there is still no money,” Vladimir recalls.

More than 200 people left the enterprise in the fall. Money was not given to anyone.

Former workers went to court, which ruled that the company should settle accounts with people.

But no one ever saw a penny. Half of the company's shares belonged to the millionaire Yuri Chizh, but in December 2014 he got rid of his part of the asset. The shares from him were acquired by Dmitry Rublevsky, the owner of the AksAlyumPro company. He also became the director. The former head, Valery Bordun, took the post of deputy for commercial issues. But nothing has changed.

“In December I received about 1.5 million rubles, in January - another 1.2 million. That's all my earnings for six months, - says an employee of the enterprise.

Those who stayed to work are promised to be registered as employees of AksAlyumPro so that we can receive a salary, but in reality nothing is being done. Therefore, people quit.

When 500-600 people worked in the summer, now there are about 150 left. “When will people get something? I would also like to know. What I can, I do. But there are pre-trial and judicial procedures that I cannot influence, - Dmitry Rublevsky comments on the situation. - As for the current workers, they receive the budget of the living wage. The court gives permission, and we pay them. "

According to the senior bailiff Leonid Mikhalevich, who is in charge of this case, the money can soon be paid.

“The property of the enterprise has already been described. But its implementation has been stopped so far. "House of Windows" wants to replace some of the equipment, which will be sold, with another, - explains Mikhalevich. - On February 24, there will be a court session, at which it will be decided whether the enterprise will be allowed such a maneuver. The money from the sale through the confiscated property will be used to pay off debts to former employees. "

Children's clothing and adult "kidalovo"

A similar misfortune happened to an employee of the Marusya garment factory, who turned to Nasha Niva. The company promised good earnings, but the promises were empty.

“For three months of my work, I received only 1.3 million rubles - part of the salary for the first month. And that’s all, ”the woman says. - Many have not yet received all the money for May in the fall.

If someone expressed dissatisfaction with this situation, others asked, how will you be paid if you are indignant? They say, there is no need to spoil relations with the authorities, so maybe they will at least pay something. The management of "Marusya", in turn, answered simply: there is no money. "

After three months of free work, the woman quit. But "Marusya" was not going to settle accounts with her.

Then the former employee went to court. The court officials advised to sign an amicable agreement with the enterprise in order to get the money as soon as possible. Within two weeks "Marusa" had to pay off, but she ignored all the terms. The money has not been paid to this day. Due to the devaluation, they have already "fallen in price" by a third.

“The bailiff Anna Dudko says that there is no money on the company's accounts, it is impossible to describe the property - it is in the mortgage. But the firm works. How - it is not known, "- says the reader.

As it turned out, the company "Marusya" consists of several different legal entities. In relation to one of them - JLLC "Marusya" - the bankruptcy procedure has already begun.

In 2011, the head of "Marusya" Marina Podobed took fifth place in the ranking of the most successful business women in Belarus. Now Marina and her husband Viktor Podobed can be prosecuted through debt on loans, which, according to various sources, ranges from 1 to 2 billion rubles.

Nobody appreciated the work of appraisers

“I don’t even expect to be paid,” Sergei Klimovich, a Grodno resident, smiles sadly.

In May 2014, Sergei, who was involved in the appraisal of cars, got tired of working without a salary at the Minsk enterprise "Belpromocenka". The further course of events is standard: he quit, went to court, the court ordered the employer to pay the money ... Klimovich received nothing.

And not only he - his colleagues, who also quit their jobs, did not see the money. Further waiting, new court orders ... But all in vain. Belpromocenka continued to ignore its former employees. The total amount that the company must pay is already approaching a billion rubles.

“Everyone is indifferent. It is simply not possible to get through to the bailiffs.

I even wrote a complaint about them to the Department of Justice, - says Klimovich. - Although I no longer count on money, I will prepare a letter to the Presidential Administration. If they don't answer, that's it. There is neither time nor desire to fight it. "

Elena Shevchik, who was the acting director of Belpromotsenka, quickly became the head of the new enterprise, BPO-Expertise. It provides the same services and even works on the former telephone numbers of Belpromocenka. It is impossible to contact Shevchik - her mobile phone is not available, and she is not at work.

The forecast is disappointing

“If a firm does not pay money to former employees, but it employs people who receive salaries, then the question arises where this money comes from. In such a situation, you should contact the prosecutor's office. Such behavior of the management can be considered as a fraud - if the founder opens another office precisely in order not to pay the debts. This is assessed by the investigating authorities and the court. We submitted such applications, and we were refused, since one of the criteria for fraud is intention, that is, if the person planned to use people and not pay. And it is very difficult to prove it, - says lawyer Sergei Zikratsky. - In general, the forecast is not encouraging. Stories when management has several firms or when they leave one and open another are not uncommon. And the law enforcement agencies are very reluctant to take on such cases. "

According to Belstat, as of February 1, 2015, 277 organizations had wage arrears in arrears. 49,300 employees are expecting their money. Overdue debt exceeds 170 billion rubles.

We strongly recommend that the partnership of owners file a lawsuit against the customer (UE Minsk Branch of the Belarusian Railways) and the contractor (OOO SPARTIS). Let those, in turn, file a recourse claim against the "Minsk House of Windows", which were engaged in the manufacture and installation of stained-glass windows. The house cannot be operated in this form. Wherever you lookthere are elastic bands hanging, the stained-glass windows are not fixed with glazing beads, some of the glass can hardly hold. The quality of the work is very low and violations are obvious here. Several glasses have already fallen out when the next one pops upIt's a question of time. Therefore, we cannot wait for a court verdict, the safety of people is under threat, and today we will make a decision to protect the building with tape, warning people about the possible danger.

Everyone had only one question for technical supervision: “Where were you looking? How was it checked? You can see everything right there with the naked eye! " There was no answer. The specialist looked silently, looking down, noting only that "during the check, everything was fine, and now too." The dropped glass just needs to be replaced, however, with one "but":

It is impossible to insert new windows on your own. Here you need to call climbers, insert glass from the outside. For this, the external fastening of the stained-glass window is removed on six floors.

According to the technical supervision representative, it turns out that at first unsecured glasses were placed on all floors, and after the window they were pressed by the external fastening of the entire frame. Those present did not succeed in presenting this process ...

But the problem goes even deeper: who will rebuild? The construction contractor, OOO SPARTIS, washes his hands. The director of the company, Alexander Klenovsky, noted at the last court session: “Engineers will go to the facility, take measurements, and we will help to establish the cause, insert new glass. But all this is at the expense of the tenants. " To which residents rightly note:

Why do we have to pay for construction defects? The house is still under warranty! And the key to the problem is not in the windows that have fallen out, but in all the stained-glass windows. It is necessary to solve the problem in a comprehensive manner, otherwise the windows will continue to fall on the heads of passers-by until the glass kills someone. All stained-glass windows must be replaced!

At the facility, the representative of "SPARTIS" also did not clarify this issue:

I am not authorized to make any decisions for the director. Whether we will eliminate the marriage, let him answer. The "Minsk House of Windows" (now bankrupt) installed these stained-glass windows, he mounted them, brought them to the end. We had no reason not to coordinate the work, because it was a serious company with a good reputation. Moreover, they won the tender, offering the most favorable conditions both in terms of terms and estimates. We, as non-window manufacturers, are not competent enough in this matter to control the process and check the quality, which is why we hired a specialized company. The fact that flaws have come out today, we see, the mounts, unfortunately, are unreliable. However, I repeat, will we deal with the elimination of marriagequestion.

Representatives of "SPARTIS" also put forward the theory that all the windows that fell out were broken. They say that fragments of glass are still preserved on the glazing beads, fragments are clamped all around: "This is nature, nothing can be done." However, it is difficult to imagine a situation in which residents break the windows in their own apartments. And looking at the glass, which by a miracle still hold, this version falls apart to smithereens.

By the way, there are enough problems in the new building besides stained-glass windows.

Double-glazed windows whistle, the wallpaper is wet after the rains, all the walls are damp and frozen, the temperature in the apartments is below normal. Almost all residents have problems with double-glazed windows: condensation splashes in the windows, all cracks whistle, people are forced to lay the windows with pillows before going to bed. There are a lot of questions about the entrance: there are no more than three people in the freight elevators, the tiles were raised on the 15th floor, but that's whatthere are no fire plugs and hoses on all floors! Where are they? When the water was turned on, our house almost drowned, water gushed straight from the wall, we were forced to substitute the basins!
