Coordination of the project in the department of cultural heritage. Adaptation project

For owners of apartments in houses that are of particular historical value, redevelopment can cause more difficulties than in ordinary typical houses, primarily due to the fact that it is necessary to coordinate changes in the apartment additionally in the Department of Cultural Heritage of the city of Moscow. In addition, only an organization licensed from the Ministry of Culture of the Russian Federation can carry out project documentation.

The main difficulties in redevelopment in the house of the monument

The complexity and main difference between the coordination of redevelopment in the house of the monument is that in addition to the main package of documents, which is necessary for any redevelopment, it is necessary to prepare additional documents, for example, a photomontage of the fact that the events planned by you will not affect the facade of the memorial house in any way, and also the project itself in its composition is significantly different from the standard redevelopment project, and it is called differently - adaptation project.

Obviously, memorial houses were built a very long time ago, otherwise they would hardly have borne such a proud title, respectively, the degree of wear of the supporting structures or engineering systems can be different, which leads to difficulties at the stage of development of project documentation. Even the demolition of curtain walls in monumental houses must be treated with extreme caution, since in most cases these walls are unloading partitions.

Also, it is worth noting that most of the historical buildings data has wooden floors, which in practice causes a lot of controversy when analyzing the activities that are provided for by the redevelopment project, which, as we have already mentioned, is even called differently in the case of a memorial house - adaptation project monument for modern use.

The procedure for agreeing on redevelopment in the monument house

The key task of the owner, according to the current law on cultural heritage objects, is to ensure that the redevelopment does not affect the characteristics and appearance of the house, which is of cultural and historical value.

If you doubt the status of your house, then its belonging to the above-mentioned objects can be found on the official website Moscow Heritage Committee.

Let's take a look at the sequence of reconciliation of the redevelopment in the memorial house point by point:

1) At the first stage, the owner should clarify the status of his house and the subject of protection. A home can be either an identified cultural heritage site or the site itself. If the house is an identified object of cultural heritage, then the subject of protection has not yet been determined. That is, the status of the house is in some "suspended" state. That is, the house, as it were, has the signs of a monument, but it is not yet a monument and "when that" must pass a commission that will determine its exact status. If the house is a monument, it is necessary to understand what is protected in it. In the vast majority of houses, this is the facade. But in our practice, there have been cases that the internal interiors were also guarded (let's say there is some kind of "historically important" stucco in the apartment. You can find out this information either from " security obligations a"(If there is one. P The application of this document is “technical condition report", Which provides complete information about the state of structures, facade and engineering systems), or by writing a request to the service of one window of the Moscow Heritage Committee.

2) Development of design documentation. The adaptation project should be developed by a design organization that has an admission license from the Ministry of Cultural Heritage and an SRO admission. (Our organization has both of these documents).

3) Submission of this documentation for consideration to the housing inspectorate. The Housing Inspectorate sends the documentation to the Moscow Heritage Committee for analysis before making its decision.

4) In most cases, the Moscow Heritage Committee issues a positive conclusion, after which the housing inspectorate issues an order for redevelopment. However, the Moscow Heritage Committee may additionally require a positive opinion from three experts in the field of monument protection, which will entail additional costs.

5) Applying for permission to carry out redevelopment works. Submitted by the owner to the one-stop shop along with the following package of documents (3 copies):

  • owner's identity document (copy).
  • adaptation project - 2 copies.
  • copy documents of title
  • notarized power of attorney if necessary
  • Mosgaz help when changing a gas stove
  • bank statement for a mortgage

If you want to agree on a redevelopment in a memorial house, our company is ready to assist you in this, we can both develop project documentation for independent approval, and provide a service for the design of the redevelopment in full.

The main condition that should be met in order to get a positive result after the state historical and cultural expertise is to preserve those structural features of the building, thanks to which the building was included in the list of cultural and historical values.

Therefore, before carrying out redevelopment, you need to develop a unique reconstruction project, as well as think over each stage of the adaptation and repair project. Such requirements apply to both residential and non-residential buildings. That is, the design documentation is initially developed, where important architectural, artistic and decorative elements, features of the layout of the premises, should be taken into account and preserved.

What is needed for redevelopment registration

Initially, the owner of the apartment should write an application and receive a Conclusion on the admissibility of redevelopment. The conclusion consists of materials that reflect the initial state of the room and how it will look after the work.

In order to draw up a project of adaptation, the following documents will be required:

  • formalized security obligation (obtained in the "single window" service);
  • a document confirming the ownership of the apartment;
  • certificates from the BTI;
  • owner's passport;
  • a document on the technical condition, which describes the subject of state protection (apartment), as well as the condition of the bearing elements.

After the adaptation project is ready, a historical and cultural examination is required. It is carried out by experts who are accredited to carry out the relevant research. The result of their work is the Act of Historical and Cultural Expertise.

The company "MVK-Service" offers its services for the preparation of a project for the device for redevelopment, as well as its approval in all instances.

Coordination of the redevelopment of an apartment in a building that is an object of cultural heritage (house-monument) is accompanied by a number of difficulties in comparison with the redevelopment of standard apartments.

Most of the residential buildings of the Central Administrative District are located in historical territories and in zones of protection of cultural heritage sites. Despite the past renovations, many buildings are dilapidated and require rather complex renovation work, which is related to redevelopment.

Immediately before redevelopment, it is necessary not only to develop an individual restoration project, but also to think over a project for the repair and adaptation of the monument in such a way as to preserve the structural features of the building, which were the reason for their inclusion in the lists of cultural and historical values. This applies to both residential and non-residential premises.

Whether your apartment is specific to architectural monuments, you should check on the website of the Moscow Heritage Committee.

Moscow legislation prescribes the approval of redevelopment in historical buildings, cultural heritage sites or identified cultural heritage sites, with the development of a project for adapting a monument for modern use, and not a redevelopment project, as in standard series of houses (in accordance with Article 44 of the Federal Law of June 25, 2002 N 73-FZ "On objects of cultural heritage (monuments of history and culture) of the peoples of the Russian Federation")).

The monument adaptation project must also contain the originals of the conclusion in the form of acts of state historical and cultural expertise, the originals of the minutes of the expert commission meetings, copies of contracts with experts, copies of the security obligation, in cases where:

  • the apartment is memorial;
  • redevelopment is carried out in the room of the memorial apartment;
  • the performance of work on the reconstruction and redevelopment of premises affects the common property;
  • work on reorganization, reconstruction and redevelopment of an architectural monument change the dimensions, proportions and parameters of the building that is under protection, or to be preserved; in particular: height, number of storeys, angle / appearance of the roof or roof.

For example:

  • Dismantling and installation of attics, windows, verandas, terraces;
  • Changing the number or shape of window / door openings in the exterior walls of the house.
  • Dismantling and installation of outdoor vestibules, porches, showcases.
  • Changing the appearance of the outer walls of the house (installation and liquidation of loggias of balconies, elements of facade decor)
  • Installation of air conditioners and other attachments.

To develop a project for adapting a monument to the customer, it is necessary to apply to the "One Window" Service of the Moscow Heritage Committee with an application and draw up a Conclusion on the admissibility of redevelopment in the premises, which constitutes an object of cultural heritage.

The duration of the conclusion is 15 days.

The conclusion should include information materials on the original appearance of the historical planning and the state of the subject of state protection after the redevelopment, as necessary, the necessary examinations, calculations and design work, as well as the requirements for the reconstruction of the lost elements of the facade decor that have historical significance, are indicated.

Project for the adaptation of the monument for modern use and protection obligation:

The owner must issue a security obligation. You can get it at the "single window" service of the Moscow Heritage Committee, where the owner applies with a certificate of ownership, a technical passport of the BTI and a passport of the owner.

In addition to the security obligation, it is necessary to obtain an Act of technical condition, which describes in detail the subject of state protection and the condition of its supporting and other structures.

With the help of our company, you can not only develop a project for the restoration of a cultural heritage site and adapt it to modern conditions, but also coordinate it in all instances, in compliance with all legal norms. Experienced designers will take into account all the necessary conditions when drawing up a project.

Work on the implementation of design solutions should be carried out by construction crews, with SRO approval, project approval is carried out by the monument protection authorities.

The project for the restoration of a cultural heritage object must undergo a state historical and cultural examination in the organization of the Conservation Department, which is also engaged in the development of projects for the repair and adaptation of premises for modern use or any other organization certified by the Ministry of Culture.

It is much more difficult to legalize the redevelopment of an apartment in a building that is included in the register of cultural heritage objects than in an ordinary typical high-rise building. Moscow legislation in the field of redevelopment requires owners of apartments in historic buildings to coordinate with the supervisory authorities not a redevelopment project, but a draft adaptation for modern use (see clause 14 of Appendix 1 of PPM No. 508 as revised 840).

What is it? Law N 73-FZ of June 25, 2002 "On objects of cultural heritage ..." in part of Article 44 gives the following definition:

"Adaptation of a cultural heritage object for modern use is research, design and production work carried out in order to create conditions for the modern use of a cultural heritage object without changing its features that constitute the subject of protection, including the restoration of elements of historical and cultural value. cultural heritage site ".

That is, when making a redevelopment, it is necessary not only to take into account the wishes of the owner, but also to preserve the characteristics that were the reason for the inclusion of the building, or the apartment itself, in the list of cultural and historical values and constitute the subject of state protection. You can find out if your house is specifically included in the list of city objects of historical significance, for example, on the website of the Moscow Heritage Committee.

A project of adaptation, which must be approved by the Department of Cultural Heritage of Moscow (Moskomnasledie), is being developed if the re-planned premises is a memorial apartment or a room in it, or its layout is of historical value, or the common property of the residents of the memorial house, protected by the state, is affected, or the appearance changes. and the dimensions of the historic building. Permission to carry out work on the adaptation project is issued by the Moscow Housing Inspection after agreement with the Moscow Heritage Committee.

Before developing the project of the adaptation, you should contact the "one window" service of the Moscow Heritage Committee with an application for registration Conclusions on the admissibility of redevelopment in a room that is a cultural heritage site or located in a house that is a given object. In accordance with the Agreement on the procedure for interaction between the Moscow Housing Inspectorate and the Department of Cultural Heritage dated 01.12.2011, this conclusion is drawn up within 15 days. It, in particular, provides information about the existing or lost historical layout, stipulates, if necessary, additional surveys or design work, specifies the requirements for the reconstruction of the lost elements of the facade or interiors, etc.

In addition, the owner of the apartment in the memorial building must take over protective obligation, which is drawn up in the form of an official document in the Moscow Heritage Committee. To do this, you should apply to the "one window" of the Department with an application. This obligation is an encumbrance of ownership and is subject to a number of conditions and limitations. For example, the owner must, at his own expense, maintain the facility in a standard condition, repair its engineering systems and let the Department staff in for inspection (at least once every two years).

An addition to the security obligation is Technical condition certificate, which says what exactly constitutes the subject of protection, and also describes in detail the state of structures, communications and decor. This act, in particular, obliges the owner of the apartment to provide the Moscow Heritage Committee with project documentation and any other similar materials within 10 days after receiving them.

A security obligation and a technical condition certificate are issued within 45 days from the date of application. Application forms can be found on the official website of the Department.

Design work related to cultural heritage sites and subject to approval by the authorities for the protection of monuments can only be carried out by legal entities that have the appropriate license (SRO approval) to carry them out. In addition, the project must necessarily pass the state historical and cultural expertise in an organization certified by the Ministry of Culture - to justify or adjust the work provided for by it. On behalf of the Moscow Heritage Committee, the Department for the Preservation and Use of Cultural Heritage Objects is engaged in expert activities, which, among other things, monitors the fulfillment of security obligations and can develop projects for adapting buildings and premises to a modern function.

To receive permits and assignments for repairs and adaptations for modern use, individuals in the "one window" of the Moscow Heritage Committee submit the following obligatory papers (in 3 copies):

A copy of the applicant's identity document.

Power of attorney for a representative (if any).
- A certified copy of the work contract and a copy of the contractor's license.
a certified copy of the contract with the designer for field supervision and a copy of his license.

A certified copy of the design documentation (except when it was developed by the Department of Design Documentation of the Moscow Heritage Committee).

On the applicant's own initiative, a copy of the document confirming the property rights to the apartment is provided (Certificate of registration of ownership or otherwise).

In addition, in accordance with clause 12 of Appendix 3 to PPM No. 508 as amended by 840, attachments for modern use are attached to the draft (in 2 copies):

Acts of historical and cultural expertise.
- minutes of meetings of the expert commission.
- copies of contracts with experts.
- copies of the security obligation.
