In the general case, the payment of maternity capital is carried out after the child reaches three years of age, but this restriction does not apply in the case of using a certificate for the repayment of a loan issued for construction. In all these cases, the size of square meters for children should not be reduced and living conditions should not be worsened. With the consent of the guardianship, in special cases, it is possible to reduce the number of square meters in new housing, which has a value greater than the value of the first house. In this case, the shares allocated to children should be equivalent in monetary terms.

Subject to these conditions, acquired with the involvement of maternity capital, is absolutely legal.

From the moment the second child is born in the family, the state provides an opportunity to use budgetary funds under the MSC program. In addition to the simplest option with the acquisition of residential real estate, many citizens decide to build their own home, which is also allowed by Federal Law No. 256-FZ.

Is it possible to use the MSC certificate for construction

In the list of possible directions for the transfer of funds under the certificate, Law No. 256-FZ allows you to build a house for maternity capital.

In this case, the following actions are invested in the concept of construction:

  • disposal of maternity capital for the construction of a new house;
  • the use of maternity capital for the completion or reconstruction of the house;
  • allocation of mat capital for actually completed construction.

The main problem that will arise for citizens who have begun building a house for maternity capital will be the confirmation of documented expenses. Conditions for receiving funds in 2020


To use maternity capital for the construction of a private house, you must comply with the conditions regulated by Law No. 256-FZ:

  1. the construction of the facility must be carried out within the Russian Federation;
  2. the land allotment on which the construction of the building is carried out must be in the ownership or other legal possession of citizens;
  3. for the construction of a house under the maternity capital program, the necessary design and estimate documentation, approved in the prescribed manner, must be available.

Required documents

To transfer funds, you must contact the territorial office of the PFR with the following package of documents:

  1. mother's statement, on the basis of which the mother's capital will be used to build a house;
  2. original MSC certificate;
  3. passports and birth certificates of all family members;
  4. an agreement, resolution or other document of title for a land allotment;
  5. permits, if required by the construction conditions;
  6. a work contract, if the family decided to hire third-party workers instead of their own forces;
  7. a notarial obligation to register the ownership of the erected object in favor of all family members no later than six months after the completion of the construction.

  • maternity capital during the construction of a house on its own will be transferred to the account of one of the spouses who carries out all the work.

How to get MSC funds for the actually built object


The question of how to build a house on mother capital will not arise if citizens built it even before obtaining the right to participate in the MSC program.

In this case, it is possible to compensate for the costs under the following conditions:

  1. the date of the actual construction of the object should be no earlier than January 2007 (when the family capital program came into force);
  2. the application for compensation followed after the second child reached the age of three;
  3. the construction of the facility was carried out by the citizens' own efforts, without the involvement of contractors.

When building on your own, the money is given out in two parts:

  1. To receive the first 50% of the mother's capital, you need the same documents as for building a house, plus your details. The money will come directly to your account.
  2. The second half of the pension fund will give only six months later. To do this, you must additionally submit an inspection certificate. This is a document that will confirm that there is actually a house on the site. The act is issued by a body that deals with architectural and urban planning issues.

How to apply for the payment of maternity capital

The application can be submitted in person at the PFR office or via the Internet - on the public services portal. But then you still need to come in person with the original documents.

Before you manage the money, you need to issue the certificate itself. This can be done immediately after the birth of a child, then wait three years and ask for money for a construction site. You can build a house at this time, and after three years you can collect compensation.

If the family already has a home

It does not matter. A family can have as many apartments as they want and still spend their mother's capital on building a house. There is no requirement in the laws for a home to be the main or only residence. The main thing is that it should be residential and, in general, the conditions for the family have improved during the construction. If the family comes to the house only on weekends, it is far from the city and there is no central heating, this is not a reason to refuse state support.

According to Federal Law No. 256, article 10, MSC funds can be used to build a house. In this case, the conditions established in the legislation must be observed:

  • the house must be built exclusively on the territory of the Russian Federation;
  • the land on which the construction will be carried out must be registered with the owners of the house. It is not necessary to become its owner. It is enough to issue a long-term lease on the site;
  • required to obtain a permit from the local authority;
  • the land must belong to individual housing construction or private household plots. Since 2019, it has become possible to build residential buildings on the lands of gardening associations. The main condition is that the house cannot be a summer building or a barn. It must be habitable throughout the year.

Important! The purchase of land with MSC funds is not allowed.

The building being erected also has special requirements, which are set out in Government Decree No. 47 of 01/28/2006. First of all, it should be a dwelling designed to exist in normal conditions, not only in the warm season, but also in the winter.

  • the building should not exceed the height of 3 floors;
  • according to SNiP 30-02-97, the distance between adjacent buildings is taken into account. So 2 buildings must have a space of at least 12 m between them;
  • reinforced concrete material is supposed to be used as the basis of the foundation of the house;
  • the house should have all the engineering equipment necessary for normal living. All rooms are supposed to have lighting. The building must be connected to the water supply and sewerage system. The house requires a ventilation system and heating;
  • in a residential area, it is necessary to comply with the basic building characteristics. For example, the dimensions of door and window openings cannot be less than generally accepted standards. The same applies to the width of the stairs, as well as the height of the steps. The height of the ceilings in the living rooms must be at least 2 m 50 cm. The size of the room allocated for the bedroom cannot be less than 8 m², and for the kitchen - less than 6 m².

Registration procedure

The procedure for obtaining MSC depends on the method that is chosen for building a house. There are 2 options for the construction of a residential building:

  1. Organization of construction on their own.
  2. Engagement of a contractor.

For both the first and second methods, before starting construction, it is necessary to obtain such documents as a MSC certificate, paper for a land plot, a work permit, and an obligation to register ownership in equal shares.

MSC certificate

To receive money from the mother's capital account, you must have an appropriate certificate on hand. For its registration, you should contact one of the offices of the PFR, where it is drawn up, to which the documents of the mother and all children are attached, as well as SNILS. The issue of issuing a certificate in accordance with the law is resolved within 15 days.

The next step is to choose a location for housing. Land should be located near transport interchanges. It is better that schools, hospitals and shops are located nearby. It is necessary that all the required communications can be brought to the house without difficulty.

To draw up documents for land, you will need to buy a plot, get it for free use or take a long-term lease.

Permission

Prior to construction, a permit must be obtained from the local municipality. The following papers are required:

  • statement;
  • title documents for land;
  • boundary plan;
  • cadastral plan;

When all the papers are collected, you can send a request for the provision of MSC funds to the FIU. It is important to consider that you can count on receiving state funds only when the baby, whose birth became the basis for issuing a certificate, is 3 years old. Before this time, it is possible to use money from the federal budget in a situation where borrowed money is attracted for construction. Additionally, the FIU may require SNILS, a marriage document.

Within a month, the submitted application is considered.

DIY construction

If the house is supposed to be built by one's own efforts, then with a positive answer after another month, the certificate holder receives state funds to his account. It is important to remember that they will not be credited all at once, but only 50% of the available MSC amount. To receive the remaining half, you need to collect new documents indicating the targeted use of budget money. In addition, it is necessary that a certain period of time has passed: at least six months.

To confirm the construction work performed, all payment documents related to the purchase of materials should be collected. Additionally, it is necessary to draw up an act on the completion of part of the work. The last document must be endorsed by a representative of the local authority.

Engagement of contractors

During the construction of a house by a contractor brigade, MSC funds are sent immediately to the contractor's account. And the full amount. In this case, the FIU will require, in addition to the documents listed above, an agreement concluded with the contractor.

There are certain requirements for the content of the contract. In addition to entering into the text of the document the main details of the parties to the transaction being concluded (the customer and the contractor), the cost of the work and the timing of its completion must be indicated. The contract sets out the rights and obligations of the parties. An important section is the definition of the order in which the finished object is received. Such a mandatory item is included in the document as the payment of the amount of MSC as a partial or full payment.

All technical documentation and estimates of construction work are attached to the contract.

In addition to the fact that MSC funds, when attracting builders, are provided immediately in full, there are other advantages of this method of building a house:

  1. The terms of work are significantly reduced, since a whole team of specialists takes part in the construction.
  2. A house built by professionals is more durable and looks better aesthetically.

Combined method

It is possible to use a combined option, which involves carrying out the main work (laying the foundation, erecting walls, laying communications) by the builders, and the owners themselves are engaged in the decoration of the premises and the facade.

Processing time

You can issue MSC funds both at the stage of the beginning of construction and upon its completion. In this case, even if the house was built only by one's own efforts without the involvement of third parties, one can immediately receive the entire amount that is on the mother's capital account.

Construction loan

Getting an MSC with a loan is somewhat different. An important note is that money can be received without waiting for 3 years of age.

An additional step to be taken is the choice of a bank and the conclusion of an agreement with it. Provided that the 2nd or subsequent baby was born after 01/01/2018, there is an opportunity to receive a loan on preferential terms, which is a low interest rate of 6%. This condition only lasts for 3 years. Then the rate will rise to the size of the refinancing percentage, but not more than 9%. The difference to the bank between the established rate and the reduced interest is reimbursed by the state.

Typically, such loans are provided for a large amount and for a long period of up to 30 years. Therefore, banks as a guarantee are asked to provide them with collateral. If the land plot on which construction is being carried out is owned by the family, then a mortgage is issued on it. Additional warranties may be required. A car, garage or other property is accepted as collateral. It is possible to attract guarantors up to 3 people. Sometimes an unfinished house is also issued as collateral.

Upon completion of construction and payment of the entire loan amount, it is required to remove all encumbrances from the land or house. After that, within six months, the right to own new housing must be formalized. As stated in the obligation, certified by a notary, the house must be divided into equal parts, which each member of the family receives, including all children.

The period during which it is impossible to sell a house built with MSC funds is not specified in any legislation.

If a house purchased on a loan and still pledged to the bank is put up for sale, then it is necessary to obtain the consent of the lender. Without this, the transaction cannot be completed.

One of the directions of using MSC funds is the construction of housing. You can do this both on your own and by hiring contractors. The chosen method of construction affects the procedure for providing mother capital. If the owners themselves are involved in the construction, then the money is allocated in 2 stages: 50% at first and 50% after confirmation of the intended use of MSCs. They are transferred by the FIU to the account of future homeowners. When concluding an agreement with builders, the entire amount of budgetary funds is immediately credited to the contractor's account. It is possible to use state funds in both cases only after 3 years, when the right to receive a certificate arose. It is immediately allowed to use MSC for construction only when taking a loan.
