Order 83 n of the Ministry of Health. On qualification requirements for employees with secondary medical and pharmaceutical education

Today we will again touch on the topic of qualification requirements, but for workers with secondary medical and pharmaceutical education.

Qualification requirements for medical and pharmaceutical workers with secondary medical and pharmaceutical education

On March 22, 2016, the Qualification requirements for medical and pharmaceutical workers with secondary medical and pharmaceutical education, approved by the Order of the Ministry of Health of Russia dated February 10, 2016 No. 83n (hereinafter - Order No. 83n), came into force.

Order No. 83n imposes qualification requirements for medical and pharmaceutical workers with secondary medical and pharmaceutical education, in full accordance with the Nomenclature of Specialties for Specialists with Secondary Medical and Pharmaceutical Education in Healthcare Russian Federation, approved by the Order of the Ministry of Health and Social Development of the Russian Federation of April 16, 2008 No. 176n, as amended on March 30, 2010. We also note that since 2010 the nomenclature of specialties has not changed.

So, Order No. 83n approved the qualification requirements for the following 35 specialties:

"Obstetrics";
"Anesthesiology and resuscitation";
"Bacteriology";
"Hygienic education";
"Hygiene and Sanitation";
"Histology";
"Disinfection case";
"Dietology";
"Laboratory";
"Laboratory diagnostics";
"Medicine";
"Physiotherapy";
"Medical massage";
"Medical optics";
"Medical statistics";
"Medical and social assistance";
"Narcology";
"General practice";

Professional retraining as a duty

Qualification requirements for medical and pharmaceutical workers with secondary medical and pharmaceutical education, approved by Order No. 83n, establish the level of professional education, the level of additional professional education, as well as positions specifically for a particular specialty.

Please note that Order No. 83n legally approves the obligation for some employees with a secondary medical education to undergo professional retraining if they have a diploma of secondary medical education.

De jure

The professional retraining of personnel in healthcare is specified in the Procedure and terms for improving professional knowledge and skills by medical workers and pharmaceutical workers through training in additional professional educational programs in educational and scientific organizations approved by order of the Ministry of Health of Russia dated 03.08.2012 No. knowledge and skills).

So, paragraph 4 of the Procedure for improving professional knowledge and skills establishes that the need for employees to undergo advanced training, professional retraining and internships is established by the employer, and also that professional retraining held in without fail for employees planning to perform a new type of medical or pharmaceutical activity.

At the same time, paragraph 10 of the Procedure for Improving Professional Knowledge and Skills states that employees who have successfully completed the development of an additional professional education program in the form of professional retraining, a diploma of vocational retraining is issued. The same provision is contained in article 76 federal law dated December 29, 2012 No. 273-FZ “On Education in the Russian Federation”.

It would seem that from the norms of the Procedure for Improving Professional Knowledge and Skills it quite obviously follows that professional retraining exists for everyone medical workers when it comes to doing a new activity. And as a result of the successful development of such a program of additional professional education, a medical worker with both higher and secondary medical education will receive the diploma of professional retraining he needs.

Order No. 83n also informs about the mandatory professional retraining of some workers with a secondary medical education, which, however, prompted us to a number of thoughts and here's why. In practice, everything is not so simple at all and de facto strongly differs from de jure, namely: today, professional retraining for nursing staff with the issuance of appropriate diplomas is not carried out by educational organizations on the territory of the Russian Federation, at least we are sure about this not known. What actually happens in practice, we will describe in the next section of this article.

De facto

The current practice in its pure form is such that in the absence of a regulatory legal act that would specifically and clearly regulate the issue of professional retraining of medical workers with a secondary medical education, professional retraining for a number of specialties was simply replaced by a specialization completed during the initial receipt of a specialist certificate, as well as when changing specialty. Such a "substitution" was schematically reflected in the Order of the Ministry of Health of the Russian Federation dated 05.06.1998 No. 186 "On the advanced training of specialists with secondary medical and pharmaceutical education." For example, for radiologists such primary specialization was 432 hours, for an anesthetist nurse it was also 432 hours, for an operating room nurse - 216 hours.

However, we especially note the fact that this Order never had and does not have the status of a normative legal act, which means that it is unacceptable to be guided by it now, with the entry into force of Order No. 83n, as in other matters before. Although, as part of the licensing inspections, the relevant executive authorities, guided by the provisions of this order, regularly involved medical organizations responsible for the lack of necessary specialization among employees.

It should be noted that neither Federal Law No. 323-FZ of November 21, 2011 “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation”, nor the Unified Qualification Directory for the Positions of Managers, Specialists and Employees, the section “Qualification Characteristics of Positions of Workers in the Sphere of Healthcare”, approved by the Order of the Ministry of Health and Social Development of the Russian Federation dated July 23, 2010 No. 541n (hereinafter referred to as the Unified Qualification Directory of Positions), nor any other regulatory legal acts did not establish requirements for this category of medical workers either regarding specialization or professional retraining. The unified qualification directory of positions defines only 2 requirements for medical workers with secondary education in the course of their work:

the presence of secondary vocational education in the relevant specialty (confirmed by a diploma of such education);
the presence of a certificate of a specialist in the relevant position of the specialty.

In the same case, if a medical worker planned to connect his labor activity with a slightly different direction, then he received a certificate of a specialist in a new specialty through advanced training, with the issuance of a certificate or certificate of advanced training, although the current legislation on additional professional education clearly established and establishes in this case, the requirement to undergo professional retraining. However, as mentioned above, professional retraining courses for workers with a secondary medical education with the issuance of an appropriate diploma are not currently held in educational organizations RF.

Unfortunately, the reality is that with the entry into force of Order No. 83n, workers with a secondary medical education who work in a different medical specialty for which they were issued a diploma of secondary vocational education do not meet the new qualification requirements, because. according to Order No. 83n, in this case they need to undergo professional retraining, and, consequently, have a diploma attesting to such retraining. Probably, this fact should be taken into account by their employers and most likely will be taken into account by the supervisory authorities soon enough. Unless, of course, appropriate clarifications from the legislator come out.

Who still needs to undergo professional retraining

It should be noted that not all medical workers with a secondary medical education will have to undergo professional retraining, but only those who carry out / plan to carry out labor activities in a specialty other than the one for which they were issued a diploma of secondary vocational education.

So, for example, considering such a specialty, approved by Order No. 83n, as "Obstetrics" (positions: midwife, senior midwife, etc.), you should know that only those workers whose main specialty should undergo professional retraining in the specialty "Obstetrics" "Medicine". Persons who initially mastered the specialty "Obstetrics" do not need professional retraining.

Here is another example: in order to occupy the position of a nurse (specialty "nursing"), employees who have a diploma of secondary education in the specialty "Obstetrics" or "General Medicine" will have to undergo professional retraining in the specialty "Nursing". For workers with secondary vocational education in the specialty "Nursing", professional retraining is not required.

According to Order No. 83n, such specialties as Hygiene and Sanitation, General Medicine, Laboratory Diagnostics, Medical Optics, Dentistry, Preventive Dentistry, Orthopedic Dentistry and a number of others do not require professional retraining if available. the employee has a diploma of secondary medical education in the specialty of the same name.
