Estimated and as-built documentation with bank support for developers

On July 1, 2018, Federal Law 175-FZ "On Amendments to the Federal Law" On Participation in Shared Construction of Apartment Buildings and Other Real Estate Objects and on Amendments to Certain Legislative Acts of the Russian Federation "and Certain Legislative Acts of the Russian Federation" Law 214-FZ of 30.12.2004) on strengthening control in the field of shared construction.

These regulations increase the responsibility of banks to control the targeted spending of equity holders' funds for construction work.

The law provides for a phased transition to a new model of housing finance using escrow accounts. From July 1, 2018, their use when attracting funds from equity holders is voluntary, from July 1, 2019 - mandatory.

For those projects that began on July 1 of this year, banking support will also include the bank's right to stop settlements if there is a suspicion about the misuse of these funds.

The list of documents required to carry out transactions on the developer's current account:

"... for the purpose of exercising control by the authorized bank, the documents are provided by the developer to the authorized bank simultaneously with the provision of orders for the transfer of funds from the developer from his current account to the bank accounts of the recipients of payments ...

⁃ contracts, goods and consignment notes for inventory items purchased directly by the developer for use in the implementation of a construction project, acts of their acceptance and transfer, documents that are the basis for payment by the developer for inventory items;

Acceptance certificates for completed works, including their individual volumes (KS-2);

⁃ certificates of the cost of work performed and costs (KS-3);

⁃ documents that are the basis for the developer to pay for contract work ".

It is clear that the Banks will not adapt to various methods and pricing schemes in construction, as-built documentation and reporting, but will form unified standards for document flow and control.

The most "fun" will begin when the obligatory FSIS TsS, GESN, NTSS of the Ministry of Construction and the resource method will be "imposed" on all this!

Bank control over the spending of equity holders' funds will be implemented quickly. For projects whose construction permits were issued before July 1, 2018, the obligation to carry out all transactions through an account with an authorized bank arises from September 1, 2018. Moreover, a separate account must be opened in an authorized bank for each apartment building under construction, if the developer carries out construction under several building permits. The technical customer and the general contractor must also open an account with the authorized bank.

The obligation to open an account with an authorized bank may arise for a developer earlier than September 1, if he begins to spend the funds of equity holders received for the creation of an object, a construction permit for which was issued on July 1, 2018 and later.

It is necessary to clearly understand what kind of control measures should be carried out by the bank in which the developer's accounts are open, what is the list of controlled banking operations and what is the measure of responsibility for possible violations ...

We can hardly imagine a clerk or even a bank manager studying PIC and interest rates ...

Objects sold under Federal Law 214, in most cases, do not pass the verification of the reliability of the estimated cost. As a result, banks will not be able to methodologically and reasonably control the amount of funds spent on construction, installation and design and survey work. As regards the disposal of these funds by banks for the construction of real estate objects, it is appropriate to equate them in status and degree of responsibility to the budgetary funds of the Russian Federation.

The Union of Cost Estimating Engineers has developed three important documents:
